Terms of Sales

These terms and conditions are responsibility of the DAM brand owned by Vogais Opacas Lda., with headquarters at Rua da Fundição 240, 3700-119 São João da Madeira, Portugal.

1. Products

1.1. DAM products are made to order. This allows attention to the detail and the customization of the products.

1.2. DAM products are manufactured and handmade in Portugal. Each product is unique and may differ from each other, presenting small features typically seen on a handmade product. The final dimensions may vary slightly. Differences of colour and tonality can happen due to common changes in the natural materials, especially cork, wood, stone, rope and straw. So we cannot guarantee the uniformity of the colours and tonalities. These changes and differences are not considered defects.

1.3. Regarding products with cork, few cork granules may be released as time goes by due to its natural characteristics. These variations are not considered defects.

1.4. Every lighting product includes bulbs and a European plug. English plugs are available under request.

2. Materials and Finishings

2.1. Samples of finishings are only representative and not an exact match of colour and tonality.

3. Customized products

3.1. Colours, dimensions or different finishings are possible at an additional cost that will be arranged with the client.

4. Prices

4.1. The prices are per unit, in Euros, excluding VAT.

4.2. We reserve the right, without prior notice, to discontinue any product, change its features and price.

4.3. Samples of materials and finishings can be shipped at an additional charge.

4.4. Cardboard packaging is always included in our prices; however, if the client requires specific packaging, the price will be charged accordingly.

5. Lead time

5.1. Our lead time is 4 to 6 weeks (excluding transport), after receipt of payment on adjudication.

5.2. For pieces with custom features or for large quantities DAM reserves the right to agree with the client the lead time.

6. Order Terms

6.1. The minimum order requirement depends on the products. Please check the price list to know the minimum quantities by product. Exceptionally, when ordering to exhibit in a store, the minimum first order should also include three different types of products.

6.2. Orders should be made by email to contact@dam.pt.

6.3. To send you the proforma invoice and move forward with your order, you must send us the following details:

Full Name
Billing and delivery address (in case they’re different)
Telephone number
VAT Number

7. Payment

7.1. After receiving the proforma invoice the payment must be made by bank transfer to confirm the order.

7.2. All orders require a 50% payment on adjudication and the balance until 3 days before the expedition date. We reserve the right to require a 100% payment in advance for the first orders.

7.3. Payment by check is not accepted.

7.4. DAM starts the production after the payment confirmation of the total amount or 50%, and the lead-time starts counting after this day.

7.5. All pieces are DAM’s property until the payment is 100% received and confirmed.

8. Shipping

8.1. DAM provides transport to Portugal, Spain, Italy, France, Germany, Belgium, The Netherlands, Luxembourg and The United Kingdom, unless otherwise stated on the order. To other countries, unless otherwise stated on the order, goods are collected by the carrier of the client’s choice. DAM can provide transport at an additional cost.

9. Damages

9.1. All products are carefully packed up and inspected prior to shipment.

9.2. Client’s transport:

9.2.1. At the time goods are picked up by the client’s carrier, the title passes to the purchaser. Therefore, the DAM is not responsible for any loss or damage in transit.

9.3. DAM’s transport:

9.3.1. Transport provided by DAM includes insurance. However, the refusal of damaged goods in no way relieves the purchaser from the responsibility of paying the goods. In case of visible damage occurs in transit, the delivering carrier should be immediately notified with initial notification of intent to file a claim.

9.3.2. Damage of any item should be reported to DAM via email within 48 hours after delivery. Photographic evidence of the damage must be included in the email and sent to contact@dam.pt.

9.3.3. All damaged goods will be replaced.

9.3.4. The delivery time will be arranged with the client.

9.3.5. Money will never be refunded.

10. Return Authorization

10.1. No returns will be accepted without written consent from DAM. Unauthorized returns will be refused at the client’s expense.

11. Distribution Policy

11.1. We reserve the right not to sell or continue to sell, to any dealer whose distribution or sales tactics result in a negative effect on our ability to compete and sell in a certain region.

12. Cleaning and Maintenance

12.1. Frequent dusting of your product will help you to maintain the lustre of varnish. Use a dry, soft cotton cloth.

12.2. Do not use abrasive detergent/cleaning products.

12.3. To protect the base of the product, verify if any surface can damage the base. Attaching felt pads to the bottom of the products can help to prevent scratches and dents as well.

12.4. Avoid contact with hot surfaces. It could leave marks which cannot be removed afterwards.

12.5. Avoid direct sunlight to keep the natural tonality of the natural materials.

13. Warranty

13.1. All DAM products are guaranteed for a period of 2 years. The warranty period begins on the date of delivery of the product to the location indicated by the buyer. It includes problems concerned with production or material faults. During this time we will repair or replace the products.

13.2. The warranty excludes all damages caused by improper installation or usage, negligence or natural wearing out of the product.

13.3. No guarantee is provided on the customer’s own fabric.

13.4. In order to benefit from the warranty offered, it is necessary to report the defect to DAM via email. Photographic evidence of the defect must be included in the email and sent to contact@dam.pt.

13.5. All defective goods will be replaced.

13.6. The delivery time will be arranged with the client.

13.7. Money will never be refunded.

14. Intellectual Properties

14.1. The website and all its contents, including, without limitation, articles, opinions, other texts, photographs, drawings, images, video or audio clips, as well as trademarks, logos, domain names, or any other source code elements that can be covered by intellectual property rights, are owned by DAM and are protected against the use, copying, or unauthorized disclosure, by national laws and by international treaties relating to Industrial property rights.

14.2. DAM can make available to the purchaser of visual and technical documents of its products. The provision of these visual documents aims to enable the buyer to develop communication and promotion of quality, consistent products sold to the reputation of the brand in its field of activity and business strategy of the brand. For this purpose, the purchaser undertakes to use these visuals with the express consent of DAM on communication media approved by DAM. These pieces of furniture and other objects and their visual representations are and remain the intellectual property of the brand DAM. Any use by third parties to the contract unless express permission is prohibited and a violation of that clause can carry cessation of trade relations between the parties.
